If current free agent Matt Harvey can find a team for next season, he might not be able to play anyway. The pitcher is reportedly facing a possible suspension by MLB after testifying at the trial for Eric Kay, according to TJ Quinn of ESPN.

In the Kay trial, Harvey testified last Tuesday that he took drugs that he had received from Kay, who was found guilty and faces a minimum 20 year sentence. He was given immunity by the prosecution so he could testify and not be legally punished, but his testimony falls under a violation of the MLB's drug policy and could lead to suspension.

MLB can't take any action against Harvey until they agree to a new CBA with the MLBPA, with negotiations reportedly set to ramp up between both sides this week. He also might not be signing with any team, as his 2021 season was not a very good one. Harvey would be able to appeal any suspension given to him.

Harvey was one of several former Angels players, and current MLB players, that testified to receiving and taking some drugs given by Kay. CJ Cron, Garrett Richards, Blake Parker, Andrew Heaney, Cam Bedrosian, and Mike Morin all testified in the trial, with Cron, Morin, Bedrosian, and Parker all admitting to usage of drugs provided by Kay.

Despite that, none of those players distributed drugs, with the exception of Harvey, which is why Harvey is the only one that is facing possible suspension by MLB. Unlike being suspended for using PED's, players using drugs such as opioids or cocaine are referred to an evaluation treatment board for a first offense, and the violation is not publicly released.

The testimony by the players, including Harvey, ended up in Kay being found guilty on two felony counts last Thursday. Kay faces a minimum of 20 years in prison, with sentencing being set for the end of June.
